Rising Stars Awards 2020 Terms and Conditions

 

General terms

Instructions on how to enter the Rising Stars Awards 2020 (“the Competition”) and details regarding the Competition contained herein form part of these Terms and Conditions. Entry into and participation in this Competition is deemed acceptance of these Terms and Conditions. This Competition is not valid in conjunction with any other offer, competition or promotion by Aston Lark Limited.

No purchase is necessary to enter the Competition.

The Competition is free to enter and open to the Independent Funeral Director sector only. The Nominee (“The Nominee”) must be a permanent resident of the UK, must be in full-time employment with an Independent Funeral Director business (“The Business”) and must have no more than 5 years experience of working within the Funeral Director profession as of the Closing Date.

The Competition commences at 17:00 hours, 24 August 2020 (“the Commencement Date”) and will close at 17:00 hours on 06 October 2020 (the “Closing Date”). Shortlisting will then commence, concluding 12:00 hours, 12 October 2020 with shortlisted individuals announced and contacted no later than 17:00 hours, 13 October 2020. The Nominees will be required to submit their Video entries to Aston Lark Limited by 30 October 2020. The Judges (“The Judges”) will then announce their Regional Winners to Aston Lark Limited on 13 November 2020, having reviewed both the initial Nomination and the subsequent Nominee footage, with Aston Lark Limited announcing the Winners formally on 19 November 2020. The period between the Commencement Date and the Closing Date shall be the Competition entry period.

Following the Closing Date, the Judges will agree and announce their Rising Star in each of the following five regions: -

  1. Scotland and Northern Ireland
  2. Wales
  3. The North
  4. The Midlands
  5. The South

The Judging shall be based only on the subjective personal opinions of the Judging panel and shall be final. Aston Lark Limited accepts no liability for the decisions made by the Judging panel and no correspondence will be entered into in this regard.

The Winner from each Region shall be determined as follows:

  1. A Judging panel shall be appointed by Aston Lark Limited in its sole discretion;
  2. After the Closing Date, Aston Lark Limited shall determine the shortlist and will arrange contact with said individuals and their Businesses;
  3. The Nominee will be asked to answer a number of questions on Video for onward consideration of the Judges
  4. The Judges shall then view the Nominee Video and have access to the initial Nomination made by the Business in order to make their final decision in the panel’s sole discretion. In the event the Judges are tied, the Head Judge for each Region will have the deciding vote.

Aston Lark Limited shall officially announce the winners of each Region direct to the Nominee and subsequently via the Funeral Service Journal and Aston Lark webpages. Articles will also feature on the Social media platform, Linked In, through the applicable channels.  

Aston Lark Limited hereby agree to contribute towards costs of all reasonable and necessarily incurred travel and Accommodation expenses when travelling to the School (The “School”) situated at Green Fuse Ltd, Riverstone, 18 Dart Mills, Totnes Road, Buckfastleigh, TQ11 0NF.

Aston Lark Limited’s maximum contribution will stand at £185 for train or flight costs; 0.40p per mile (capped at no more than the costs allowed for train and flight costs) if travelling by road and hotel costs of £135 per night, per Regional Winner.

If this Competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of Aston Lark Limited, Aston Lark Limited reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any Entrant; or (b) to modify, suspend, terminate or cancel the Competition, as appropriate.

Aston Lark Limited hereby reserves the right to change, suspend or cancel the Competition, or to change these terms and conditions, by notice on the Aston Lark Limited website. Aston Lark Limited shall not be required to specify any reasons for the changes and shall not incur any liability as a result.

Aston Lark Limited collects both Company information and Personal information of the Nominee in order to conduct the Competition and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and as required by law, to regulatory authorities. Entry to the Competition is conditional on providing this personal information, and You and the Nominee must consent to the use of their information for the purposes of the Competition. These Terms and Conditions shall be governed by and construed in accordance with the laws of the UK.) Aston Lark does not accept liability for any information provided by Green Fuse.

Terms and conditions applying to the Nominating Funeral Director

To participate in the Competition, You must first be a Partner, Director and/or Directors of an Independent Funeral Director business (“You”). For Your nomination to be accepted and considered in the Competition, You must ensure that your Nominee is a full-time member of staff who is within their first 5 years of working within the Funeral Director Profession, and will still be inside of their first 5 years by the Closing Date of the Competition. The Nominee must also be a full-time UK resident. All submissions to the Competition will be required by You via the following webform: https://www.astonlark.com/risingstars/nominate

By entering the Competition, You hereby warrant that all information submitted is true and accurate to the best of your knowledge. Any Nomination by You that is later found to have purposely supplied incomplete, inaccurate or fraudulent information may be automatically disqualified from the Competition.

Aston Lark Limited reserves the right to disqualify any Nomination and/or Nominee if Aston Lark Limited has reasonable grounds to believe that a Nomination and/or Nominee has breached any of these terms and conditions or has tampered with the Competition process. Failure by Aston Lark Limited to enforce any of its rights at any stage of the Competition does not constitute a waiver of those rights.

The Nomination by You, and subsequent content provided by the Nominee, must not defame any person or entity, or be disparaging to any religion, race, or nation, or contain language that is lewd, obscene or inappropriate, or use any copyrights, images, marks, trademarks or logos for which You, the Business or the Nominee has not obtained permission for. Aston Lark Limited reserves the right to disqualify any Nomination made that cannot comply with the conditions set out in this clause.

Incomplete, indecipherable or illegible entries will be deemed invalid. You and the Nominee bear all responsibility to ensure that Your entry is complete and legible, and that their content is submitted in the correct format and clearly visible and audible.

By entering the Competition, You acknowledge, agree and declare that you will afford the Nominee, if chosen as the Regional Winner for 2020, suitable absence away from the Business in order to attend and complete the training courses as set out in these Terms and Conditions.

The dates for the training are as follows: -

The training will be provided on four separate days between the months of March and April 2021. The training provided with involve both face-to-face training sessions and those taking place via web-based platforms.

Any cost associated with accessing the Competition website is the responsibility of You and is dependent on the Internet service provider used. Aston Lark Limited makes no guarantee of the availability of its web services and will not be held responsible for interruption of service that may interfere with the ability to participate in the Competition.

Terms and Conditions applying to the Nominee (Shortlist)

On being Shortlisted, the Nominee (“You”) and the Business will be contacted using the information supplied by the Business at the Nomination stage of the Competition.

You will be required to provide Your confirmation that You accept Your ongoing inclusion in the Competition. By accepting your ongoing involvement in the Competition, You confirm that You are prepared to shoot, feature and submit a video answering a small number of questions as set by the Judges and to the reminder of the below Terms and Conditions;

If You or the Business do not respond to such contact from Aston Lark Limited within 7 days of notification, then the Invitation will be withdrawn.

The Video itself can be recorded in any way that You deem suitable but must not defame any person or entity, or be disparaging to any religion, race, or nation, or contain language that is lewd, obscene or inappropriate, or use any copyrights, images, marks, trademarks or logos for which You have not obtained permission for. Aston Lark Limited reserves the right to disqualify any Video made that cannot comply with the conditions set out in this clause.

You agree to allow Aston Lark Limited to share your Video content amongst the panel of Judges and agree to allow Aston Lark Limited the use, or potential future use, of said Video material for promotional purposes in connection with the Rising Stars Competition.

You also agree to allow Aston Lark Limited to feature You in future editions of the Funeral Service Journal by way of profiling which will include Your Image and short Biography.

By entering the Competition, You acknowledge, agree and declare that you will attend and complete the training courses as set out in these Terms and Conditions. The dates and courses are as follows: -

The training will be provided on for separate days between the beginning of February and the end of April.

The training course modules will include

  • Responding to changing trends.
  • Arranging complex funerals.
  • Funeral conducting skills.
  • Caring for the body & mortuary management.

The course titles are subject to change due to the training provider agreeing that they will check the experience of all five winners to make sure the training is suitable and is tailored accordingly.

By entering the Competition, You hereby warrant that all information submitted is true and accurate. Any information supplied by You that is later found to have supplied incomplete, inaccurate or fraudulent data will result in automatic disqualification. Aston Lark Limited reserves the right to disqualify any Nomination and/or Nominee if Aston Lark Limited has reasonable grounds to believe that a Nomination and/or Nominee has breached any of these terms and conditions or has tampered with the Competition process. Failure by Aston Lark Limited to enforce any of its rights at any stage of the Competition does not constitute a waiver of those rights.

If selected as a Regional Winner, You agree to participate in reasonable post-competition publicity for Aston Lark Limited at Aston Lark Limited’s expense, including but not limited to Your attendance for interviews, photographs, videos and any other promotional activity specified by Aston Lark Limited. You also grant a non-exclusive, irrevocable licence to Aston Lark Limited to use your name, biographical details, photographs, videos, likenesses and any other information regarding You deemed appropriate for use by Aston Lark Limited for any promotional and marketing purposes by Aston Lark Limited for a period of one (1) year from the Closing Date.

The winners shall be entitled to receive the applicable Prize providing that the above terms are met.
